New Delhi : Supreme court has said that the Right to education law (RTE) will not be applicable for the Minoriy Education Institutions. The Law is not applicable for the Government Aided Minority institutions also.
This institutions cannot be hence obligated to Reserve 25 Percent Seats for the students from socially and economically weaker sections of the society. A five-judge Constitution Bench headed by Chief Justice R M Lodha said that the Act will not apply to aided or unaided minority institutions.
The Apex court Also made clear that that the government cannot impose mother tongue on linguistic minority for imparting primary education. It also said the state cannot force choice of language on the ground that it would be more beneficial to the child.
The Children and their Parents have right to choose the language for instruction in primary school.
The petitioner had submitted that the three-judge bench in 2012 had erroneously held Article 21A to be constitutionally valid for non-minority unaided educational institutions while holding it to be unconstitutional so far as minority-run educational institutions are concerned.
MES has welcomed the Supreme court verdict. Christian Management Educational Institution representative George paul Said that the verdict will not affect the minority institutions of Kerala.
