Land Recovery From Harrison Malayalam; Set Back For Government


Kochi:The government action to recover the extra land from Harrison Malayalam. High Court had rejected the petition filed by government against the legal action in Vythiri Taluk land Board.It is the Taluk Land Board to resolve the issue on land of Harrison Malayalam.Whether a foreign company can hold the ownership of land is a constitutional issue and can not be considered in the gien petition said the division bench including Justice Thottathil B.Radhakrishnan and Justice A.V Ramakrishna Pillai.Since the petition is rejected, the interim orders against Harrisson Malayalam stands invalid and that will also add to difficult situation for the government.
The Court had ordered to the Government to return the Bank Guarantee for 180 million by Harrison Malayalam before the High Court Registrar.Also the interim orders ,making the company merger subject to the final decision on petition, not to cut down the trees and not to transfer the properties are also made invalid. The government had taken initiatives to re acquire almost 60,000 acres of land under the possession of Harrison Malayalam Plantations.Against this the government gave petition saying that the legal actions at Vythiri Land Board are on false documents and so that has to be cancelled.The court also rejected the petition given by K.Jagadeesh Chandran Nair requesting the High Court,to call and verify the records on legal actions against Harrison Malayalam in Pathanamthitta Court.The Court said,this has to be heard in the Sub Court and decided there on.
